1. INTRODUCTION

1.1 Teamther.ai is committed to protecting the privacy and security of the data entrusted to us. This Privacy Policy explains how we process personal data as a provider of the AI-Assisted CV Screening and Rating Service (“Service”).

1.2 Our data practices comply with the European Union’s General Data Protection Regulation (GDPR), the UK GDPR, and other applicable international data protection standards. We process personal data only for legitimate, specified, and lawful purposes, and we apply appropriate technical and organizational measures (TOMs) to safeguard the information entrusted to us.

1.3 For individuals located in the United States, our data practices are intended to comply with applicable U.S. privacy laws, which may vary by state.

2. ROLES UNDER GDPR (EU/UK Users)

2.1 The Client (You): Data Controller — As a client using the Service (e.g., Employer or Recruitment Agency), you are the Data Controller of the Candidate Data.

2.2 Teamther.ai (We): Data Processor — Teamther.ai acts as a Data Processor operating strictly on your documented instructions. We process Candidate Data solely to provide you with the CV screening and evaluation Service.

3. TYPES OF DATA WE PROCESS

3.1 Candidate Data (Processing as a Processor): The job profile, complete CV content, identification and contact data, work experience, education, skills, certifications, and AI-generated insights derived solely from the data you upload.

3.2 User and Account Data (Processing as a Controller): Registration data (name, contact details), organization data, billing data, usage data, and communication data.

4. PURPOSES AND LEGAL BASES FOR PROCESSING

4.1 For Candidate Data: To provide the AI-assisted CV screening and scoring Service, generate AI Score/Insights, classify and organize data to assist your recruitment and human decision-making.

4.2 For User and Account Data: Account management, authentication, billing and subscription administration, and communication regarding Service updates and security.

4.3 Automated Decision-Making and AI Transparency: Teamther.ai uses artificial intelligence to assist in the screening, scoring, and classification of CVs. AI-generated outputs are provided solely as decision-support tools. Teamther.ai does not carry out solely automated decision-making producing legal or similarly significant effects on candidates within the meaning of Article 22 GDPR.

5. DATA SECURITY AND STORAGE

5.1 Security Measures: Encryption of data in transit (TLS/SSL) and at rest (AES-256 or equivalent), strict access controls, and regular audit and monitoring of our systems.

5.2 Location and International Transfers: Candidate Data is stored primarily in secure data centers located in Netherlands. Transfers outside EU/EEA are made with appropriate safeguards such as the European Commission’s Standard Contractual Clauses (SCCs).

6. DATA RETENTION PERIOD

6.1 Candidate Data: Retained as long as your subscription is active. CV documents are retained for a maximum of 12 months and automatically deleted after this period. Upon termination, all Candidate Data will be deleted from our production servers within 30 days, unless otherwise required by law.

6.2 User and Account Data: Retained for the duration of the contractual relationship and thereafter as long as necessary to comply with applicable legal, tax, accounting, audit, and statutory limitation obligations.

7. DATA SHARING AND DISCLOSURE

We do not sell or rent your Candidate Data or User Data to third parties. We share data only with trusted sub-processors bound by strict contractual obligations, when required by law, or in the event of business transactions.

8. YOUR RIGHTS AS A DATA SUBJECT (EU/UK Users)

In accordance with GDPR, you have the following rights: right of access, right to rectification, right to erasure (“right to be forgotten”), right to restriction of processing, right to object, and right to data portability. For any requests, please contact us at support[a]teamther.ai.

8.1 No Selling or Sharing of Personal Information (U.S. + GDPR): Teamther.ai does not sell or share Candidate Data or User Data for cross-context behavioural advertising or any commercial purpose unrelated to the Service.

8.7 Use of Data for AI Model Training: Teamther.ai does not use Candidate Data or User Data to train, improve, or develop any external machine-learning models or algorithms, except where expressly agreed in writing with the Client.

9. CHANGES TO THE POLICY

We may update this Privacy and Data Policy from time to time. We will notify you of any material changes by email or via a notification on the Service at least thirty (30) days before the changes take effect.
